RULES AND REGULATIONS

- ANGELUS MEMORIAL PARK, INC. and VALLEY MEMORIAL PARK are (Perpetual Care) Permanent Endowed Care Cemeteries. The term, (Perpetual Care) Permanent Endowed Care means to keep the lawn mowed in the Gardens at reasonable intervals, all places where interments have been made in proper order and to care for trees and shrubs planted by the cemetery. (Hereinafter the word "cemetery" shall refer to either cemetery of the Corporation.)
- All grading, landscape work, improvements of any kind, care of Gardens, trees, shrubs and herbage of any kind shall be planted, trimmed, cut and/or removed at the sole discretion of the Corporation. Only the Corporation shall perform all opening and closing of graves, all interments, disinterments and removals.
- Visitors are prohibited from picking flowers, breaking or cutting any trees, shrubs or plants. Hunting or shooting within the Cemetery is absolutely prohibited. The Cemetery grounds are sacred, devoted to the interment of the dead and it is incumbent on all visitors to conduct themselves with becoming propriety.
- The Owners, Heirs, Executors, Personal Representatives and/or Assignee of each lot or grave space shall have the right to purchase and have installed flat surface markers fulfilling the specification as to size, thickness, quality and installation set forth in the rules promulgated by the Corporation. Owners preferring to secure bronze surface markers from other sources will be responsible to insure they meet all specifications of the Corporation. No marker other than flat bronze, granite or marble surface markers will be used in this Park. Flat granite and marble markers require a waiver of liability for perpetual care and maintenance damage.
Reference Exhibit A - Marker Specifications
- The bases for all bronze surface markers shall be prepared and installed only by employees of the Corporation and at such reasonable charges fixed by the Board of Trustees.
The Corporation reserves the right to correct any error made by its employees in the location or placing of a memorial in the Cemetery.
- Before placing any monument, marker, other structure or inscription on any lot, approval must be obtained by the Board of Trustees.
- Ownership of an interment space consists of the right of interment or memorial of human remains. The lot can not be used for any other purpose.
- No transfer or assignment of any interment space or interest therein shall be valid without the prior written consent of the Corporation. No transfer of conveyance shall be effective without such consent; such consent will not be unreasonably withheld.
- AII interments in grave space, crypt or niche shall be restricted to the immediate family of the owner thereof unless special permission in writing is given by the owners and approved by an authorized Representative of the Corporation, but which approval shall not be unreasonably withheld.
- The Corporation cannot divide grave spaces into smaller portions that were originally platted except as deemed necessary.
Reference Exhibit B - Multiple Burial Specifications
- The Corporation will furnish all equipment for interment services. Arrangements and payments for interment or disinterment of remains, whether ground burial or crypts, public or private, shall be forty-eight (48) hours in advance of interment or disinterment.
- A fireproof, refrigerated facility is available to those requiring temporary storage. It offers a resting-place when seasonal weather or family reasons prohibits burial until a later date. The Corporation reserves the right to reject any application for acceptance of remains. All remains must be embalmed. The storage fee must be paid In advance before the remains can be accepted for temporary storage.
Reference Exhibit C - Storage
- Interments will generally be restricted to the months of MAY, JUNE, JULY, AUGUST, SEPTEMBER and OCTOBER. The Corporation requires an outside container or vault shall be furnished by the Purchaser and shall be used for all interments. All outside containers or vaults used by the Purchaser for interments shall be of concrete or metal, except where other materials shall have been approved by the Corporation for said use. The Board of Trustees reserves the right to make exceptions to this policy and the right to require financial reimbursement and indemnification that is necessary to protect the Corporation.
- Any member of the Corporation desiring to be heard before the Board must first contact the Corporation office during regular business hours and state the nature of his business. The office will submit his name to be placed on the order of Business for the next regularly scheduled Board Meeting. No member may, at any time, take the nature of his business to any individual Officer or Trustee. In the event the member's business is emergency in nature, the Corporation office will contact the Board of Trustees on his behalf.
- All members of the Corporation shall, at all times be subject to the rules, regulations, conditions, restrictions, and the by-laws at this time, or amended or created hereafter by the Board of Trustees, for the government of the lot owners for conducting the affairs of said ANGELUS MEMORIAL PARK, INC.
- The Corporation reserves the right to remove any decorations, plant or trees that are unsightly or a detriment to the Park.
- The Park can provide temporary Markers. Temporary markers will be removed from graves 60 days after interment.
- The Corporation shall have the right to maintain guards if deemed necessary but is under no legal obligation to do so. The Corporation distinctly disclaims all responsibility for loss or damage from causes beyond its reasonable control, damage caused by the elements, an act of God, the common enemy, thieves, vandals, strikers, malicious mischief makers, explosions, unavoidable accidents, insurrections, riots or order of any military or civil authority, whether the damage be direct or collateral.
- The Corporation reserves the right to correct any error in making Interments, disinterments or removals. Also in the description, transfer or conveyance of any interment property, either by cancellation, exchange or conveying in lieu thereof for interment property of equal value and similar location. If the error should involve interment of remains in such property, the Corporation reserves the right to remove and re-inter the remains to other property of equal value and similar location. The Corporation shall not be held liable in situations where an error(s) has been made. The Corporation shall have the right to correct any error made by employees in the location or placement of an inscription on a marker or on the container for cremains.
- No interment shall be permitted in or marker placed upon any property not paid in full, except by special consent in writing by an authorized Representative of the Corporation. A promissory note shall not be considered as payment. No right for interment shall be acquired by the purchaser of said property until paid in full, including principal and late charges. In case the purchaser of said property fails to meet all payments within thirty (30) days after demand by the Corporation, the Corporation may repossess said property and hold the same as of its former estate. The Corporation thereupon shall be released from all obligations and may retain such payments made toward the purchase of such property as liquidated damages. The Corporation shall have the right immediately or at any time thereafter, without notice, to remove to single graves, chosen by the Corporation, each of the remains then interred in said property. The Corporation shall also have the right to remove any markers or memorials that may have been placed or said property.
Exhibit A - Markers
- Markers on graves in all baby internment areas may not be over 20 inches in length.
- Each single grave may not have more than two markers, each not to exceed 24" x 16" or one companion marker not to exceed 36" x 16".
- Companion markers are not to exceed 44" x 14" when placed on two spaces.
- A separate vase unit may be installed in addition to markers.
- It is prohibited to place crushed marble or other foreign material around markers.
- Granite and marble markers require a waiver of perpetual care and liability for maintenance damage.
Exhibit B - Multiple Burial Specifications
- Adult Space: An adult space can have two cremain burials, or one full burial and one cremain burial. An adult space can have two full burials if the soil allows and the request is made at the time of the first burial.
- Infant Space: An infant space can have one casket burial per space or two cremain burials per space. "Babylands" are solely for the internment of infants and children.
- Exceptions to these specifications require the approval of the Board of Trustees.
Exhibit C - Storage
- All deceased individuals requiring use of our storage facility must be embalmed.
- All visitations to the storage area are limited due to safety hazards. If a viewing is required, the presence of a mortician is required.
